Agreed all party press statement:
"The parties to this case have agreed that the appeal against the first instance Judgment in this case will no longer be pursued. Each party will bear their own costs of the appeal.
"No settlement payment for the use of the pictures in this action has been made by the BBC and Brighter Pictures.
"All parties have agreed not to pursue any outstanding costs from the dispute at first instance.
"Whilst strongly disagreeing on the principles, the parties wish to find a pragmatic resolution and put this matter behind them and move forward."
